Terms & Conditions

Age Restrictions - WARNING

Under the Liquor Control Reform Act 1998, it is an offence;

  • To supply alcohol to a person under the age of 18 years. (Penalty exceeds $6000)
  • For a person under the age of 18 years to purchase or receive liquor. (Penalty exceeds $500)

Prices and Payment

All prices are quoted in Australian Dollars and may be per bottle/item or per case, as marked. All prices include Goods and Services Tax (GST). Unless specified, any delivery charges are additional.

We accept payment by Diners, Visa, Mastercard, and American Express.

Please Note:

Minimum order is one dozen bottles.
A re-packaging fee of $5 applies to partial or mixed dozens.

Delivery

Our preferred delivery service is Australia Post All wine orders can be delivered to an address in Australia, including Post Office boxes. Australia Post will deliver Monday to Friday between the hours of 9.00 am - 5.00 pm. Most of our customers give instructions to leave the wine in a safe place, otherwise if the person accepting the delivery is out and there are no delivery instructions, Australia Post will leave a card in the mail box so you can collect your wine at your local Post Office. Please note Australia Post will not re-deliver and we cannot accept instructions to contact you as Australia Post couriers cannot call before delivery.

  • Allow 10-14 working days for most locations. This can vary at peak times and for remote locations.
  • Freight Charges range from $6 to $30 per 16 kg carton of wine,depending on the delivery address.
  • On certain wine offers we may offer a subsidised or a flat rate delivery fee. See individual offers for details.

Byrne & Smith Wines and the contracted courier company will not be held responsible for any missing goods when delivered without a signature. Please note that all delivery prices are subject to change without notice.

Stolen Wine and Breakages

If you give us specific instructions to leave your wine, (we prefer that if no-one is home the wine is then available for collection from the local Post Office), and the wine gets stolen, you are responsible. Under special circumstances we will consider replacing the wine free of charge. If there are any breakages, please notify us by calling or 08 8272 1900 or email us at peterh@byrneandsmith.com.au.

Returns

If some or all of the bottles of wine in a case are broken, corked, oxidised or not of merchantable quality when they are delivered, please notify us as soon as possible. You may choose either to return the whole case for a refund or a replacement. We will refund you as soon as the wine is picked up and received back into our warehouse.

Any wines collected by Australia Post must be in their original box to avoid further breakages, where possible.

Limitation of Liability

Nothing in these terms and conditions shall exclude Byrne & Smith Wines Pty Ltd online's liability for personal injury or death caused by its negligence.

Subject to the above statement, Byrne & Smith Wines Pty Ltd will not be liable for loss or damage caused by the customer handling the wine. In particular, we will not be liable for spillages or breakages.

Byrne & Smith Wines Pty Ltd will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

  1. loss or damage was not foreseeable to both parties when the contract was formed;
  2. loss or damage was not caused by any breach on the part of the supplier;
  3. loss or damage relates to business and/or non-consumers.

Customers should also be aware of the following inherent risks and warnings:

  1. Alcohol should be consumed in moderation;
  2. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight, we advise that you transfer the bottles 1 or 2 at a time;
  3. Red wine in particular may cause staining if spilt so extra care should be taken;
  4. Sparkling wines and Champagnes can be volatile due to the build up of gasses so extra care should be taken when opening these.
